Terms of Service
The contract between CliqBook and the shops that use the service: subscription, billing, responsibilities and limits.
Effective [effective date]
The French version of this document is presented first and prevails. Lire la version française. By continuing with the English version, you expressly choose to be bound by it.
1. Agreement
These terms form a contract between [Nom légal de l'entreprise / Legal business name], which operates CliqBook ("CliqBook", "we"), and the business that creates a CliqBook account (the "shop", "you"). By creating an account or using the service, you accept these terms, as well as the Privacy Policy and the Data Processing Terms, which form part of them.
The person accepting these terms confirms they are at least 18 and authorized to bind the business. The service is intended for businesses; it is not offered to consumers for personal use.
2. The service
CliqBook provides an online booking page, a calendar, team and service management, reminders and emails, reports, timesheets and client retention tools. We may improve, change or remove features; we will give advance notice before removing a significant paid feature.
Your shop's clients book without a CliqBook account. Appointments, prices and cancellation policies are your shop's; CliqBook is not a party to the contract between your shop and your clients.
3. Accounts and team
- Provide accurate information and keep it up to date.
- Keep passwords safe; you are responsible for actions taken with your shop's accounts.
- You choose who you invite to your team and what they can see. Remove access for people who leave the shop.
- Tell us promptly at [email protected] about any unauthorized use.
4. Subscription, trial and billing
- The CliqBook plan costs CA$79 per month per shop, plus applicable taxes (GST and QST).
- A 14-day free trial may be offered once per shop. A payment card is required at the start; it is charged when the trial ends unless you cancel before then.
- The subscription renews automatically every month and is paid in advance through Stripe.
- You can cancel at any time from the Billing page. Cancellation takes effect at the end of the period already paid; partial months are not refunded unless the law requires it.
- If a payment fails, the service stays available for 7 days. After that, dashboard access and online booking are suspended until payment; your data is kept.
- We will give at least 30 days' notice before any price increase. It will apply from the next renewal.
5. Your data and your clients' data
The data you put into CliqBook, including your clients' data, belongs to you. You only give us the right to use it to provide, secure and improve the service, as set out in the Privacy Policy and the Data Processing Terms.
As the party responsible for your clients' information, you must: collect it lawfully, inform your clients, only send promotional emails to clients who consented, honour unsubscribes, and respond to access, correction or withdrawal requests.
You can request a copy of your data at [email protected]. After the account closes, it is deleted from our live database no later than 90 days later, unless the law requires otherwise.
6. Acceptable use
You may not:
- use the service for illegal purposes or to send unsolicited messages;
- upload content that infringes others' rights or is offensive;
- try to access another shop's data, bypass security measures or disrupt the service;
- copy, resell or reverse engineer the software.
We may suspend an account that breaks these rules or endangers the service or other users, with notice when reasonably possible.
7. Availability and support
We make reasonable efforts to keep the service available at all times and make daily backups. Interruptions may occur for maintenance or for reasons beyond our control. Support is available by email at [email protected].
8. Intellectual property
CliqBook, its software, trademarks and content belong to us. You get a non-exclusive, non-transferable right to use it during your subscription. You keep the rights to your logos, photos and content, and allow us to display them to provide the service. If you send us suggestions, we may use them freely.
9. Warranties and liability
The service is provided as is. To the extent permitted by law, we give no warranties other than those set out in these terms. You remain responsible for checking your appointments, prices, payments and tax filings.
To the extent permitted by law, our total liability to you is limited to the amounts you paid us in the 12 months before the event, and we are not liable for indirect losses, such as lost profits or clients. These limits do not apply to intentional or gross fault, or to bodily or moral injury caused to a person.
10. Ending the contract
You can end the contract by cancelling your subscription. We may end it with 30 days' notice, or immediately for a serious breach of these terms. The sections on data, intellectual property and liability continue to apply after the contract ends.
11. Changes to these terms
We may change these terms. We will email you at least 30 days before a significant change takes effect. If you do not accept the change, you can cancel your subscription before it applies.
12. Governing law and language
These terms are governed by the laws of Québec and the federal laws of Canada that apply there. The courts of the [judicial district of Montréal] have jurisdiction, unless the law provides otherwise.
These terms are first presented in French. The English version is provided for convenience at the adhering party's express request. If the versions differ, the French version prevails.
